Antenuptial is an agreement or a written contract between two people before they are married. An antenuptial, or prenuptial lists the property each person owns any liabilities or debts, and specifies what each person’s property rights will be after the marriage ends. In some states, a prenuptial agreement is known as an antenuptial agreement, or, a premarital agreement.

 

Antenuptials are not just for the wealthy or celebrities. While prenuptial lawyers are often used to protect the assets of a wealthy fiancé, couples without large estates may need a family lawyer or a divorce lawyer to prepare a prenuptial agreement.

A couple with children from prior marriages can use an antenuptial to determine what will happen to their property after they die, and pass on property to their respective children and each other,as desired. Without a prenuptial lawyer making a valid contract, a surviving spouse might be able to claim the other spouse’s property, leaving little or none for their offspring.
Some marrying couples without children may want to spell out their financial rights and assets during their marriage.

To avoid potential arguments if getting divorced, a divorce attorney looks at the premarital or post marital agreement for direction to see how their property will be divided.
A few states disallow a spouse to give up the right to alimony, however, a waiver will be checked thoroughly for validity, and not upheld if the spouse who is giving up alimony didn’t have a prenuptial lawyer or divorce attorney.

Antenuptials can protect spouses from each other’s debts.

If you don’t make a prenuptial agreement, the state’s laws will decide who owns what property from before or acquired during the marriage. An Arizona prenuptial can be quite different from a Colorado prenuptial. They determine what happens to property at divorce or death.

The law states that marriage is a contract between the marrying couple, and the contract includes property rights for each spouse. If you don’t agree with the way these property, divorce, and probate laws are applied then you need to see your family lawyer, a divorce lawyer, or a prenuptial lawyer to cater a marital contract to your requirements.
